A PROCLAMATION
This proclamation ends a grave national injustice (140 Capitol and Metropolitan Police were assaulted on Jan 6th by rioters, One died from injuries and two committed suicide after the attack. One rioter was shot by police, one died of a heart attack and one was trampled to death in the stampede. There is a estimated $1.5 million in damages that were done to the capital building.) that has been perpetrated upon the American people over the last four years and begins a process of national reconciliation.(Never Forget)
Acting pursuant to the grant of authority in Article II, Section 2, of the Constitution of the United States, I do hereby:
(a) commute the sentences of the following individuals convicted of offenses related to events that occurred at or near the United States Capitol on January 6, 2021, to time served as of January 20, 2025: After researching each member on this list it is clear the original crime and grave national injustice was the excessive spreading of lies by Donald J. Trump, his sons Don Jr. and Eric Trump, Rudy Giuliani, Roger Stone, Alex Jones, Fox News and other right wing voices.
• Stewart Rhodes : Founder of the Oath Keepers a far-right, anti-government militia. Nov. 2022 convicted of seditious conspiracy and evidence tampering relating to Jan. 6th US Capitol attack. May 2023 sentenced to 18 years in prison and 36 months of supervised release.
• Kelly Meggs : Leader of the Oath Keepers Florida chapter. Found guilty of seditious conspiracy after forced entry in the US Capitol Building during the Jan. 6th attack. Sentenced to 12 years in prison and 36 months of supervised release. The official DOJ website has currently deleted his conviction page but the Internet Archive has screenshots before it was deleted and we have link this on his name.
• Kenneth Harrelson : Member of the Oath Keepers Florida chapter. On Jan 2023 found guilty of obstruction of an official proceeding, conspiracy to prevent an officer from discharging duties and tampering with documents or proceedings. Sentenced to 4 years in prison and 24 months supervised release. The official DOJ website has currently deleted his conviction page but the Internet Archive has screenshots before it was deleted and we have link this on his name.
• Thomas Caldwell : Retired Navy Intelligence Officer. Found guilty, Nov 2022 of obstruction of an official proceeding and tampering with documents or proceeding. Caldwell spent 50 days in jail after arrest in 2021 and was cleared of the four most serious charges and sentenced to no additional jail time. At the time of this pardon he was already cleared. The official DOJ website has currently deleted his conviction page but the Internet Archive has screenshots before it was deleted and we have linked this on his name. *Caldwell was given a full pardon since this proclamation
• Jessica Watkins : Notably expressed remorse for her involvement in Jan 6th. She has talked about being lead to such extreme actions after listening to Alex Jones for 5 hours a day whom has been proven to spread lies. She is a transgender former military officer who served our country proudly and we are including this information as she tried to help the current presidency whom has now issued many executive orders against the transgender community. Former member of the Oath Keepers, found guilty of conspiracy to obstruct a official proceedings and Interfering with police. Sentenced to 8.5 years in prison and 36 months supervised release. The official DOJ website has currently deleted her conviction page but the Internet Archive has screenshots before it was deleted and we have linked this on her name.
• Roberto Minuta : Member of the Oath Keepers. Jan 2023 found guilty of seditious conspiracy, conspiracy to obstruct an official proceeding, obstruction of an official proceeding, aiding and abetting, and conspiracy to prevent a member of Congress from discharging their official duties. Sentenced to 54 months in prison and 36 months supervised release.
• Edward Vallejo : Notably expressed remorse and regret for his involvement on Jan. 6 attack. Member of the Oath Keepers. Convicted of seditious conspiracy, obstruction of an official proceeding and conspiring to obstruct and conspiracy to prevent Members of Congress from discharging their official duties. Sentenced to 36 months in prison and 36 months supervised release, including the first 12 months to be served on home confinement.
• David Moerschel : Member of the Oath Keepers. Convicted of seditious conspiracy, obstruction of an official proceeding and conspiring to obstruct and conspiracy to prevent Members of Congress from discharging their official duties. Sentenced to 36 months in prison and 36 months supervised release.
• Joseph Hackett : Member of the Oath Keepers. Convicted of seditious conspiracy, obstruction of an official proceeding and conspiring to obstruct and conspiracy to prevent Members of Congress from discharging their official duties. Sentenced to 42 months in prison and 36 months supervised release.
• Ethan Nordean : Self described "Sargent of Arms" for the Proud Boys, a right-wing, neo-fascist all male militant organization. Found guilty of seditious conspiracy and other felony crimes. Charged with obstructing or impeding an official proceeding, aiding and abetting, knowingly entering or remaining in restricted building or grounds and violent and disorderly conduct on Capitol grounds. Sentenced to 18 years in prison. The official DOJ website has currently deleted his charges page but the Internet Archive has screenshots before it was deleted and we have linked this on his name.
• Joseph Biggs : Army Veteran awarded Purple Heart from combat, organizer with the Proud Boys, a right-wing, neo-fascist all male militant organization. Found guilty of seditious conspiracy, obstruction of an official proceeding, criminal conspiracy, conspiracy to prevent an officer from discharging any duties, interference with law and enforcement during civil disorder and destruction of government property. Sentenced to 17 years in prison.
• Zachary Rehl : Former US Marine and leader in Philadelphia chapter of the Proud Boys, a right-wing, neo-fascist all male militant organization. Convicted of seditious conspiracy and conspiracy to obstruction an official proceeding. Sentenced to 15 years in prison and 36 months of supervised release.
• Dominic Pezzola : Former US Marine and member of Proud Boys, a right-wing, neo-fascist all male militant organization. Convicted of obstruction of a Congressional proceeding, civil disorder, assaulting an officer, robbing an officer and destroying the window. Sentenced to 10 years in prison and 36 months supervised release.
• Jeremy Bertino : Former member of the Proud Boys and first one to plea guilty to seditious conspiracy and unlawful possession of a fire arm. Bertino testified against other Proud Boy members. He was not at the capitol on Jan. 6th but used digital communications to support the insurrection. Could not find records of a sentencing.
(b) grant a full, complete and unconditional pardon to all other individuals convicted of offenses related to events that occurred at or near the United States Capitol on January 6, 2021; (The Trump Administration has not given an explanation as to why some convicted attackers were commutations instead of full pardons. Notably Enrique Tarrio, the leader of the Proud Boys with the highest sentence of all the convictions at 22 years in prison was given a full pardon.)
The Attorney General shall administer and effectuate the immediate issuance of certificates of pardon to all individuals described in section (b) above, and shall ensure that all individuals convicted of offenses related to events that occurred at or near the United States Capitol on January 6, 2021, who are currently held in prison are released immediately. The Bureau of Prisons shall immediately implement all instructions from the Department of Justice regarding this directive.
I further direct the Attorney General to pursue dismissal with prejudice to the government of all pending indictments against individuals for their conduct related to the events at or near the United States Capitol on January 6, 2021.
